1. Acceptance of Terms

By accessing or using the Diamond Emporium website (diamondemporium.co.za) or placing an order through our Shopify store, you confirm that you have read, understood, and agree to be bound by these Terms of Service, together with our Returns & Refund Policy, Shipping Policy, and Privacy Policy. If you do not agree to these terms, please do not use this website or place an order.

2. About Us

Diamond Emporium is an online-first diamond and engagement ring retailer operating in South Africa. We offer natural and lab-grown certified diamonds, as well as bespoke and catalogue engagement ring designs. Our diamond inventory is sourced through Nivoda, an international diamond marketplace. Rings may be manufactured to order through our production partners.

3. Eligibility

You must be 18 years of age or older to place an order or enter into any agreement with Diamond Emporium. By using this website, you confirm that you meet this requirement. We reserve the right to refuse service at our discretion.

4. Product Information

We take care to ensure all product descriptions, specifications, certifications, and pricing are accurate. However:

  • Diamond characteristics (carat, cut, clarity, colour) are as stated in the accompanying GIA, IGI, or equivalent certification.
  • Images are for illustrative purposes and may not reflect the exact stone you receive.
  • Ring designs shown are representative. Bespoke or custom-order rings may vary slightly based on your specifications.
  • Prices are displayed in South African Rand (ZAR) and include VAT at the applicable rate unless otherwise stated.

5. Pricing and Payment

All prices are listed in South African Rand (ZAR) inclusive of VAT. Diamond Emporium reserves the right to adjust pricing without prior notice, except where an order has been confirmed and payment received.

A 50% deposit is required to secure production and reserve your diamond. The remaining balance is due prior to dispatch. Accepted payment methods are as displayed at checkout.

6. Made-to-Order and Special-Order Goods

The majority of our products — including bespoke engagement rings, custom designs, and rings manufactured to client specifications — are made-to-order or special-order items. Under the Consumer Protection Act 68 of 2008 (CPA), made-to-order goods are not automatically subject to the general right of return unless the goods are defective.

By placing an order for a made-to-order item, you acknowledge that the goods are being produced specifically for you, and that cancellations or returns after production has commenced may not be possible. Your statutory rights under the CPA remain unaffected.

7. Manufacturing Lead Time

Our standard manufacturing lead time is a minimum of 20 working days from the date your deposit is received and your specifications are confirmed. This is an estimate and not a guaranteed delivery date. Delays due to supplier lead times, production requirements, or logistics are possible. We will communicate any material delays to you.

8. Dispatch and Delivery

Dispatch occurs Monday to Thursday only (excluding Fridays, South African public holidays, and weekends). Collection appointments are available on Mondays, Wednesdays, and Thursdays. Transit time is typically up to 3 business days after carrier collection for domestic delivery. For full details, refer to our Shipping Policy.

9. Returns and Refunds

You must notify us of any return request within 7 calendar days of delivery. Returns are assessed in accordance with our Returns & Refund Policy. A discretionary admin fee of up to R500 may apply per return request. Made-to-order items are final sale unless defective. Your rights under the CPA are not limited by this policy.

10. Consumer Protection Act (CPA)

These terms are subject to the Consumer Protection Act 68 of 2008. Nothing in these Terms of Service limits, excludes, or modifies any right or remedy you have under the CPA. Where there is any conflict between these terms and the CPA, the CPA shall prevail.

11. Protection of Personal Information (POPIA)

Diamond Emporium collects and processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). By using our website and placing an order, you consent to the collection and processing of your personal information for the purposes of fulfilling your order, communicating with you, and complying with our legal obligations. You have the right to access, correct, or request deletion of your personal information by contacting us at legal@diamondemporium.co.za.

12. Intellectual Property

All content on the Diamond Emporium website — including text, design, photography, logos, and branding — is the intellectual property of Diamond Emporium or its licensors. You may not reproduce, distribute, or use any content without prior written consent.

13. Limitation of Liability

To the maximum extent permitted by South African law, Diamond Emporium shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website, the purchase of our products, or delivery delays beyond our reasonable control. Our total liability shall not exceed the amount paid by you for the specific order in dispute.

14. Accuracy of Information

We reserve the right to correct pricing errors or product description inaccuracies at any time. If a pricing error is discovered after your order is placed, we will contact you before proceeding with fulfilment. You may choose to continue with the corrected price or cancel your order.

15. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or your use of our website shall be subject to the jurisdiction of the South African courts.

16. Changes to These Terms

Diamond Emporium reserves the right to amend these Terms of Service at any time. The version date at the top of this document indicates when it was last updated. Your continued use of the website after changes are published constitutes acceptance of the updated terms.
